EU orders Microsoft to disclose the dangers associated with GenAI in Bing search or incur fines

Following Microsoft’s failure to reply to a March 14 request for comments about particular dangers arising from Bing’s GenAI capabilities, the European Commission on Friday ordered the tech giant to disclose more information about the generative AI (GenAI) features in its search engine Bing, or face fines.

The Microsoft corporation now has until May 27 to provide the material sought by the Commission on Bing’s generative AI capabilities, including “Copilot in Bing” and “Image Creator by Designer,” after the Commission intensified its enforcement efforts against the firm.

The Commission may impose fines of up to 1% of Bing’s total annual revenue or global turnover, as well as recurring penalties of up to 5% of the provider’s average daily revenue or worldwide annual turnover, if Bing does not respond by the deadline.

Additionally, in response to an information request, the regulator has the authority to sanction a provider up to 1% of their global sales or total annual revenue for providing inaccurate, deceptive, or incomplete information.

“Following its designation as ‘Very Large Online Search Engine’, Bing is required to comply with the full set of provisions introduced by the Digital Services Act (DSA),” said the Commission.

In response to the “legally binding request for information,” Microsoft has not yet responded.
