An Important Win for Indian Immigrants Under the New Policy
Indian immigrants, who make up one of the biggest immigration groups in the country, have gained significantly from the new policy. The EAD is crucial for many Indian immigrants’ ability to live and work in the US. Indian immigrants’ life would be more secure and stable with the new five-year validity term.

Maximum Validity Extended by US Citizenship and Immigration Services
The maximum validity period of Employment Authorization Documents (EADs) has been increased by US Citizenship and Immigration Services (USCIS) to five years for a select group of non-immigrants, including those who are vying for asylum, withholding of removal, INA 245 status adjustments, suspension of deportation, or cancellation of removal.

As a result, these non-immigrants won’t need to renew their EADs as often, saving them both time and money. In order to shorten processing timelines and clear backlogs, the USCIS also wants to accept fewer new EAD renewal applications.

Position of President Joe Biden Regarding H-1B Visa Renewal
According to Reuters, the government of President Joe Biden recently declared that it will make it simpler for Indians to live and work in the United States. A limited number of Indians and other foreign employees on H-1B visas may soon be permitted to renew their visas in the United States without leaving the country, according to a recent announcement from the State Department.

Indian nationals accounted up 73% of the approximately 442,000 H-1B employees in fiscal year 2022, making them by far the most frequent users of the U.S. H-1B program.

A State Department official was reported by Reuters as stating, “The State Department has already been working extremely hard to identify innovative approaches to make adjustments.

Pilot Program for Holders of H-1B Visas
H-1B visa holders who are laid off are not included by the pilot program for domestic visa stamping for H-1B visa holders. H-1B employees who have been laid off have 60 days to depart the country, find employment, or petition to switch to another visa.

This is because only H-1B visa holders who are actively working in the US are eligible for the pilot program. H-1B employees who have been laid off are not eligible for the program since they are no longer working.

The pilot program is a positive step for H-1B visa holders, but it’s crucial to remember that it does nothing to help those who have been fired from their jobs. H-1B employees who are laid off may have trouble finding new employment or switching to other visas, and if they are unable to do so within 60 days, they risk being deported.
