Mahua Moitra’s request for temporary protection against defamatory information is denied by the Delhi HC

Mahua Moitra, the leader of the TMC, was recently expelled from the Lok Sabha. On Monday, the Delhi High Court denied her interim motion, which sought to stop BJP MP Nishikant Dubey and counsel Jai Anant Dehadrai from sharing or uploading any “fake and defamatory” material against her online.

In delivering the ruling, Justice Sachin Datta said, “I have dismissed the injunction application”.

The high court heard arguments from the attorneys representing Moitra, Dubey, and Dehadrai on December 20, 2023, and then deferred its decision about the interim application.

In October of last year, the expelled member of the Lok Sabha from West Bengal’s Krishnanagar filed a plea seeking a permanent injunction against Dubey, Dehadrai, social media platforms X, Google, YouTube, and 15 media houses, prohibiting them from making, publishing, or disseminating statements that are malicious, defamatory, or ex facie false about her.

She has also requested compensation. Later, she removed all media outlets and social media middlemen from the parties’ memo and restricted her legal action to Dubey and Dehadrai.

For raising questions in Parliament, Dubey has accused Moitra of accepting payments from businessman and CEO of the Hiranandani Group, Darshan Hiranandani.

Referencing a correspondence he obtained from counsel Dehadrai, Dubey said that the latter presented him with “irrefutable” proof of purported bribery given by the businessman to the TMC leader.

In his letter to the speaker of the Lok Sabha, Dubey asserted that 50 of the 61 questions the former TMC MP had previously asked in the Lok Sabha were about the Adani Group, a business conglomerate that the MP has frequently accused of engaging in unethical practices, particularly after it was the subject of a damning report from short seller Hindenburg Research.

The Lok Sabha Ethics Committee recommended Moitra’s expulsion from the lower house in response to these accusations, and on December 8, 2023, she was banished.
