The BJP petitions the Supreme Court to overturn a Calcutta High Court judgment prohibiting the printing of advertisements disparaging Trinamool

May 24, New Delhi The Calcutta High Court’s judgment prohibiting the Bhartiya Janata Party (BJP) from publishing “derogatory” and “offending” advertising against the Trinamool Congress has been challenged by the BJP in the Supreme Court.

The issue was brought up for instructions seeking an urgent listing before a vacation bench led by Justice Bela M. Trivedi on Friday.

The BJP’s attorney successfully convinced the Bench, which also included Justice Pankaj Mithal, to consider listing the case.

Calcutta High issued an ex-parte injunction last week that forbids the printing of advertising that blatantly infringes upon the political rights of Trinamool and its officials.

The Model Code of Conduct (MCC) forbids any participant in the electoral process from criticizing other parties or their employees based on unsubstantiated claims or distortion, according to a bench of Justice Sabyasachi Bhattacharyya of the high court.

It claimed that the Indian Election Commission “grossly failed” to respond to the governing Trinamool Congress’s objections in a timely manner.

As a result, respondent no. 2 (BJP) is prohibited from publishing the offensive advertising any longer until June 4, 2024, or until an additional order is issued, whichever comes first. During the aforementioned time, respondent no. 2 is prohibited from printing advertising in any media that violates the MCC issued by the ECI, according to the HC judgment.
