“Uncertainty and chaos”: Chief Justice Chandrachud on why every judgment made by the Center is final

The Supreme Court scolded the petitioners during the Article 370 hearing, declaring that no decision made by the Union government on behalf of a state may be contested in the highest court. The Supreme Court affirmed the repeal of Article 370 in its decision, but it also ordered the fastest possible return of statehood. It requested that elections be held in Jammu and Kashmir by the Election Commission of India (ECI). The Supreme Court, presided over by Chief Justice CI Chandrachud, issued these statements when it rendered a decision on a number of cases contesting the repeal of Article 370 of the Constitution.

“There are numerous decisions taken by the Union government on behalf of the State government for the purpose of day-to-day administration,” the Supreme Court said during the Article 370 hearing. There is no appeal process for any choice or action made by the Union leadership on behalf of the State.”

The Supreme Court said that there would be chaos and confusion if every decision made by the Center was not subject to dispute. “There would be chaos and uncertainty if every decision were open to review. The Supreme Court said that it would bring the administration to a complete halt.

“The President’s authority to conduct daily business cannot be subject to ongoing court scrutiny.It is untrue to argue that you were unable to make an irrevocable choice under President’s Rule without using Article 368. The Supreme Court said that the goal of Article 370 was no longer to allow Jammu and Kashmir to become a fully integrated part of the country.

ARTICLE 370 RULING BY THE SUPREME COURT

The Supreme Court has unanimously affirmed the repeal of Article 370, but it has also ordered that Jammu and Kashmir’s statehood be reinstated “as soon as possible” and “at the earliest opportunity.”

Additionally, the Election Commission has been instructed by the Supreme Court to schedule the Jammu and Kashmir polls on September 30, 2024. CJI Chandrachud said, “We direct that steps shall be taken by the Election Commission of India to conduct elections by September 30, 2024, to the Legislative Assembly of Jammu and Kashmir, constituted under Section 14 of the Reorganisation Act.”
