A new bill introduced in parliament would increase the maximum sentence for identity concealment and having sexual relations under false promises of marriage to ten years

It is punishable by up to 10 years in jail to have sexual relations with a woman while making false promises of marriage, promotion, or job.

This measure, which first provides a particular provision to address these offenses, has been submitted in Parliament.

The Bharatiya Nyaya Sanhita (BNS) Bill, which will replace the Indian Penal Code (IPC) of 1860, was submitted in the Lok Sabha by Union Home Minister Amit Shah. He said that clauses pertaining to crimes against women had received particular attention, according to PTI.

“Crime against women and a number of the societal issues that they encounter are addressed in this law. According to the article, he said that having sex with women on the false pretense of marriage, job, promotion, or a fake identity would now be a criminal.

It said that although courts have dealt with examples of women suing for rape after their marriages fell through, there is no particular IPC provision for this.

“Whoever, by deceitful means or making by promise to marry to a woman without any intention of fulfilling the same, and has sexual intercourse with her, such sexual intercourse not amounting to the offence of rape, shall be punished with imprisonment of either description for a term which may extend to ten years and shall also be liable to fine,” the bill, which will now be reviewed by a Standing Committee, stated.

Furthermore, it specifies that “deceitful means” include enticement, marriage after hiding one’s identity, and the false promise of job or advancement.

According to the newspaper, the proposed measure also changed the sentence for voyeurism from three to seven years to be gender neutral.

The modifications, according to Shah, were implemented to speed up the judicial process and build a legal system that takes into account peoples’ modern demands and ambitions.

According to the bill, a conviction for murder will result in either the death penalty or life in prison; a conviction for rape will result in at least 10 years in prison or life in prison; and a conviction for gang rape will result in at least 20 years in prison or life in prison for the offender.

The bills state that the offender shall be punished with rigorous imprisonment for a term that shall not be less than 20 years but which may extend to imprisonment for life, meaning imprisonment for the remainder of that person’s natural life, or with death if the victim of the rape dies as a result of the assault or if the assault leaves the victim in a persistent vegetative state, according to the report.

According to the law, anyone found guilty of raping a child under the age of 12 faces a minimum sentence of 20 years in prison, a maximum sentence of life in prison (meaning they would be imprisoned for the rest of their natural lives), a fine, or even the death penalty.

Anyone who commits rape will also be subject to a fine in addition to a strict sentence of at least 10 years in jail, with the potential for a life sentence.

According to the article, anybody who commits rape, including a police officer, public employee, or member of the armed forces, would be sentenced to a minimum of 10 years in jail and a maximum of life in prison.
