Allow Children to Play Outside and Return to Homemade Food Rather Than Restaurant Parcels: Kerala High Court

The Kerala High Court recently urged families to forego restaurant delivery through platforms in favor of eating at home and letting their kids play outside.

“Let the kids play cricket or football or other games they like in their free time,” stated Justice PV Kunhikrishna. This is essential for a youthful, healthy generation that will lead our country’s future by serving as its lights of hope. Instead of ordering meals from restaurants via Swiggy and Zomato, let the kids to sample the delectable cuisine their mother makes, let them play on playgrounds at that time, and then bring them home to the enticing aroma of her cooking.

The court said, “I leave it there to the wisdom of the parents of minor children of this society.”

The matter before the court included an offense relating to pornography. The accused was charged under Section 292 when it was discovered that he was standing by the side of the road using his phone to watch pornographic material.

The accused said that there was no evidence that his behavior may appeal to children or that he had shown the film in public.

The court ruled that Section 292 of the Indian Penal Code (IPC), which punishes, among other things, the sale, etc., of obscene literature, does not apply to someone viewing an offensive picture or video on his mobile phone in private. The court emphasized, “The offence under Section 292 IPC is attracted if the accused is trying to circulate or distribute or publicly exhibit any obscene video or photos.”

So, according to Justice Kunhikrishna, the accusation against the defendant was not supported by sufficient evidence before the court of Judicial First Class Magistrate. As a result, it was defeated.

Before concluding, he said that although viewing pornography may not be illegal, there would be serious repercussions if young children begin to watch the pornographic movies that are now available on all mobile devices.

He emphasized that parents are providing their small children mobile phones with internet connection as gifts on such occasions “instead of delicious food made by the mother and a cake-cutting ceremony on children’s birthdays to make them happy.”

Justice Kunhikrishna emphasized that the parents must inform their children of the risk involved.
