Governor’s Refusal To Name Ponmudi As Minister: Supreme Court Will Examine Tamil Nadu’s Argument

On Monday, the Supreme Court decided to take up a challenge from the Tamil Nadu government challenging Governor RN Ravi’s denial of K Ponmudi, a prominent DMK politician, being appointed as a minister in the state cabinet.

Re-instating the former Higher Education Minister and senior DMK politician in the state government has been declined by the governor, who cited concerns about morality and constitutionality.

Senior attorney Abhishek Singhvi made some compelling arguments for the state government before a panel made up of Chief Justice D Y Chandrachud, judges JB Pardiwala and Manoj Misra. The court noted the urgency of the case and ordered a hearing.

The governor claimed that the Supreme Court had merely issued an interim order suspending Ponmudi’s conviction in a letter to Chief Minister MK Stalin. The head of the Stalin cabinet was not to be appointed by the governor.

Ponmudi was recently re-instated as a lawmaker by the state government after the Supreme Court’s suspension of his conviction in a case involving excessive assets.
