HC increases the penalty for unlawful block defaulters

Kolkata: The Calcutta High Court increased the petitioners’ penalties by three on Wednesday for failing to pay the fee for erecting a structure without permission. Instead, arguing that the petitioners had filed an appeal before the division bench against the court judgement, the petitioners’ attorney asked the court for an extension of time to pay the first punishment of Rs 1 lakh.
“I intend to increase the expense,” Justice Amrita Sinha said.

The petitioners were ordered by the court to pay the higher fine by March 22, 2024, or else it will be raised even more.
Judge Sinha noted that the writ petition “seeking regularisation of an absolutely unauthorised construction raised without sanction” had been denied by the court on March 12, 2024.
It seems that the petitioners received sufficient encouragement to submit the writ petition. The order was issued by the court after a comprehensive hearing. Because they had moved the division bench, the petitioners purposefully opted not to pay the expenses and requested further time for payment, according to Justice Sinha.
According to Justice Sinha, there isn’t currently an injunction restraining the court’s order.
The court cannot turn a blind eye when it comes to the injustice that is being committed. Judge Sinha said that in order to stop such unauthorised buildings, the individuals responsible for them should learn a valuable lesson.
On March 27, the petitioners were instructed by the court to turn in the payment receipt.
