In a 27-year-old case, the Supreme Court clears a man from Hoshiarpur

A Hoshiarpur man who was given a life sentence for allegedly murdering a man in 1997 has been cleared by the Supreme Court, ruling that the prosecution’s witnesses’ testimony was “wholly unreliable.”

A bench of Justices BR Gavai and Sandeep Mehta acquitted Kirpal Singh, saying, “Having given our thoughtful consideration to the entirety of the material available on record, we are of the firm view that evidence of Sharan Kaur, prosecution witness (PW) -5, and Daljit Singh (PW-6) is wholly unreliable and does not inspire confidence in the court so as to affirm the conviction of the appellant.”

The Punjab and Haryana High Court’s February 28, 2008, ruling, which upheld the accused Kirpal Singh’s conviction and sentence from the Additional Sessions Judge (Adhoc), Hoshiarpur, on July 26, 2003, was the subject of an appeal filed by Singh.

In the intervening night of November 12–13, 1997, in the Hoshiarpur district, Kirpal Singh is accused of fatally stabbing Balwinder Singh and seriously wounding his wife Sharan Kaur.
