Three defendants in the gangrape-murder of a lady and the murder of her two children in Delhi have received the death punishment

A Delhi court recently sentenced three men to death for gang-raping and killing a lady and her two young children, a boy, 7, and a girl, 6, in addition to the woman.

The lady was strangled after being initially slain by the inmates with a screwdriver. They then murdered her two children before robbing the home. This issue is related to the vicinity of the Khyala police station.

2015 saw the registration of a FIR. The dead woman’s husband filed the case. The terrible rape and killings were committed by four people, one of whom was a child.

Shahid, Akram, and Rafat Ali alias Manzoor Ali were given the death penalty by Special Fast Track Court Judge Aanchal of the Tis Hazari Court for the crimes of murder and criminal conspiracy under sections 302 and 120B.

For the crimes of gang rape and robbery, they were given life sentences. Each convicted person has also been fined Rs. 35,000 by the court. The defendants were found guilty by the court on August 22.

The three defendants, Shahid, Rafat Ali, and Akram, were found guilty of conspiring in the case, according to the court.

Call records and supporting evidence, including recoveries made in response to disclosure statements, “prove that there are reasonable grounds to believe that the conspiracy between accused Shahid, Akram, and Rafat Ali and one JCL existed before the date of the incident, even on September 19, 2015, and it continued until September 23, 2015, when the proceeds of the crime were shared among the accused persons,” the court stated.

The court also saw a pattern in which no calls were made back-to-back but rather after a gap of many minutes or hours. Rafat Ali departed Delhi on September 21 at about 10 a.m. Shahid then arrived at Anand Vihar, Delhi, at 10:29 p.m. on the same day to leave Delhi, and his location was in Aligarh at 10:34 a.m. on September 22.

The court noted that although Akram was still outside of Delhi’s network at 8:20 a.m. on September 23 and the child had been in the roaming network since 8:20 a.m. on September 22, 2015, there was always communication between the person leaving Delhi and Shahid, followed by calls between Shahid and Rafat Ali, and the same when the accused leaving Delhi arrived at his destination.

“It is very odd that frequent calls were being exchanged between the SIM used by Shahid and Akram only around the time which matches to the time of the commission of three murders and a number of calls were being exchanged between four only on the date of commission of the offence and on 23.09.2015, the day they were in Aligarh,” the court remarked.

Despite the fact that the conversation contents are not recorded, the court said that the defendants’ phone records demonstrate very unusual behavior that strongly suggests their participation in the commission of the crimes of three murders, one rape, and three robberies.

“These are proved as a link connecting them to the crime of the present case and these are also the evidence which proves that the four accused Rafat Ali, Shahid, Akram, and Juvenile were sharing a common agreement to commit the offence, which is proving that the accused Rafat Ali, Shahid, Akram, and Juvenile were sharing a common agreement to commit the offence,” the court added.

On the basis of the husband of the deceased woman “S” and the father of her two deceased children, who were discovered dead on the second floor of their home in Raghubir Nagar, Delhi, on September 21, 2015, the FIR in this matter was filed.

When he inquired at his level, Shabbu, the son of another tenant who lives on the first floor of the same house, said that Akram and ‘H’ alias ‘F’ (minor) and two boys, ascending the stair, went into the deceased’s room and locked the door, and he had not seen anyone else go there. The complainant said he didn’t believe Akram, H, and his two buddies had stolen those items and killed his wife and kids. In addition to disclosing the accused Akram’s father’s name and residence, he claimed to know both Akram and H.

Section 376 (Rape) of the IPC was inserted based on the post-mortem findings of the dead “S.” Additionally, after information from the informant, the two accused Shahid and Mohd. Akram were detained on October 4, 2015, at a park close to HMP Raghuvir Nagar.

They were questioned, and when they admitted to committing gang rape, murder, and robbery with the dead along with their friends Manzoor and H, the case was upgraded under Section 376(D) of the Indian Penal Code. Shahid and Akram, the two defendants, were detained.

Accused Shahid was found in possession of one mobile phone with two IMEI numbers and SIM cards, while Accused Akram was discovered in possession of a black Lava mobile phone with two IMEI numbers and SIM cards as well as some cash.

Rafat Ali was taken into custody from Aligarh, while the child was taken into custody from Khajuri Chowk.
