Section 75 of the Juvenile Justice Act is added by the Uttar Pradesh Police to the FIR filed against the teacher who instructed students to strike a classmate

In a recent development, the Uttar Pradesh Police added Section 75 of the Juvenile Justice Act to the FIR filed against Tripta Tyagi, a teacher who is accused of telling her pupils to spank a Muslim classmate for not doing his homework.

The Juvenile Justice Act specifically addresses cases in which a person in charge of a child physically abuses, abandons, mistreats, or wilfully neglects the kid. In accordance with this clause, violators risk a harsh jail sentence of three to 10 years and a fine of Rs 5 lakh.

Initially, Tripta Tyagi was charged on August 26 as a result of a complaint made by the boy’s relatives. The accusations included non-cognizable crimes under IPC Sections 323 (willful harm) and 504 (intentional insult with purpose to cause breach of peace). However, Circle Officer Ravi Shankar stated that Section 75 of the Juvenile Justice Act was included in the FIR against the schoolteacher in light of the continuing inquiry.

This move was in response to a viral video that went viral on August 25 and showed Tyagi, a teacher at Neha Public School in Khubbapur Village, Muzaffarnagar District, telling her pupils to smack a second-grade child while also making a racial comment.

The National Commission for Protection of Child Rights, the country’s top organization for defending children’s rights, as well as other political officials had strong responses to the video and demanded that the accused teacher be subjected to disciplinary penalties.

Tyagi argued in defense of herself that the video had been edited to stir up conflict and asserted that the boy’s uncle had taken the footage. She admitted that she had caused a student to be slapped by his classmates, but she countered that she was physically unable to reach the student who had not finished his task.
