Digital Personal Data Protection Bill approved by Parliament

The Digital Personal Data Protection Bill 2023 was approved by the Parliament on Wednesday.

After the opposition members of the Rajya Sabha staged a walkout over the Manipur issue, the bill was approved by the chamber on a voice vote, according to PTI.

The law was already approved by the Lok Sabha on Monday.

The measure, which was released six years after the Supreme Court declared that the “Right to Privacy” is a fundamental right, contains safeguards to prevent internet platforms from abusing users’ personal data.

 

The law puts forth requirements on corporate and public bodies surrounding the acquisition and processing of citizen’s data, according to the newspaper citing Union Minister Ashwini Vaishnaw.

 

The newspaper said that the law “seeks to safeguard the privacy of Indian citizens while proposing a fine of up to Rs 250 crore on entities for misusing or failing to safeguard the digital data of individuals.”

 

Union IT Minister Ashwini Vaishnaw moved the measure for discussion and approval in the Upper House of Parliament, saying, “It would have been good had the opposition discussed the bill today (in the House).” The rights of the citizenry, however, are not a priority for any opposition leader or member.

 

He said that a thorough public engagement process led to the bill’s introduction.

 

He emphasized the key aspects of the measure by claiming that it is written in a straightforward manner that even the average person can comprehend.

 

According to the concept of legality, which Vaishnaw cited in reference to certain guiding principles for the bill, information about an individual must be obtained in accordance with applicable laws and is only permitted to be utilized for that reason.

 

Due to their absence from the chamber when the measure was placed to a vote, John Brittas and V Sivadasan’s motion to refer the bill to the Parliament’s select committee was not supported.
