The Supreme Court rules in Yash Raj Films’ favor in the issue involving Shah Rukh Khan’s “Jabra Fan.”

The Supreme Court of India overruled a prior decision by the National Consumer Disputes Redressal Commission on the removal of the song “Jabra Fan” from the Shah Rukh Khan film Fan, which seemed to be a victory for Yash Raj Films.

The 2021 judgment had mandated that YRF pay a moviegoer Rs 10,000 as recompense for being duped by the song’s omission from the picture. The Supreme Court has now ruled in favor of YRF in the legal dispute about the song’s inclusion in the film.
Afreen Fatima Zaidi filed a complaint, claiming that she and her kids were dissatisfied that “Jabra Fan” was removed from the movie, particularly after it had been promoted in trailers.

Zaidi said that her children’s health was even put at risk by this negligence. At first, the NCDRC endorsed Zaidi’s position, classifying the marketing tactic as unfair commercial conduct in accordance with the Consumer Protection Act.
YRF had claimed that the allegations were inflated and that the complainant had not suffered any losses as a result of the song “Jabra Fan” simply not being included.
After the complainant’s petition was denied by the District Consumer Forum in 2017, the State Commission of Maharashtra granted her appeal and ordered the production company to pay her Rs 10,000 in compensation plus Rs 5,000 for legal fees. Additionally, the NCDRC issued an order supporting the complaint.
The bench of the Supreme Court said that they have considered the consequences of a trailer and promo song as well as the contractual responsibilities associated with them. The appeal has been accepted.
