How Naveen Patnaik Saved the Modi-Led NDA in the Rajya Sabha as the Delhi Ordinance Ruckus United Oppn

The Naveen Patnaik-led BJD MPs, who are in Delhi for the Monsoon Session of Parliament, had not heard from Bhubaneswar as of Monday night regarding their party’s position on the contentious Delhi Services Bill and the no-confidence motion against the BJP-led NDA government.

Party sources indicated that the BJD would vote against the motion of no confidence and in favor of the Delhi Services Bill on Tuesday night, just hours before the GNCDT Amendment Act, 1991 was to be submitted in the Lok Sabha.

Given the BJD’s track record of helping the Narendra Modi-led government escape a sticky situation in the Rajya Sabha when the NDA lacks the numbers, the expectation turned out to be accurate. The BJD has backed the government’s decision to revoke Article 370 in 2019.

The Congress MP from West Bengal and party leader in the House Adhir Ranjan Choudhury opposed the Delhi Services Bill on Tuesday after it was introduced by MoS Home Nityanand Rai on behalf of Home Minister Amit Shah. He claimed that the bill “justifies the outrageous infringement of this government on the territory of states.” It’s intended to create a significant cooperative federalism cemetery.

The introduction of the Bill was contested on a number of grounds, including legislative competence, by RSP MP NK Premachandran, AIMIM MP Assaduddin Owaisi, Trinamool MP Prof. Sougata Roy, Congress MPs Gaurav Gogoi and Shashi Tharoor, and DMK MP TR Baalu.

After then, BJD MP Pinaki Misra spoke out in favor of introducing the Bill. Misra, who seemed to be defending the NDA administration, said: “Honorable Speaker Sir, there are some very, very intelligent Members of Parliament here who know the law well. I find it surprising that there is absolutely no mention of the actual Supreme Court ruling or the order that the Supreme Court has issued while legislative competence is being considered under Rule 72 proviso.

“The Supreme Court’s spoken order of seven pages in the writ case brought by the State of Delhi against the Union of India. Please review what the Supreme Court stated in para. 95. About legislative competence, it concludes. Please note that the court states, “However, the executive power of the LG shall be modified to the extent as modified in that law if Parliament enacts a law granting executive power on any subject which is within the purview of NCTD.” In response to the Supreme Court giving it authority, the administration has now proposed a statute. How therefore can you contest the legitimacy of legislation?

The BJD MP emphasized that while one might vote against the Bill, it could not be objected to on a legal basis.

The following speaker was Amit Shah. “Under Article 249, this House has the authority to introduce any legislation pertaining to Delhi. The House is authorized by the Constitution to enact any legislation pertaining to the state of Delhi. According to the Supreme Court’s ruling, Parliament may introduce any legislation pertaining to the state of Delhi. Every criticism is political. Permit me to present this Bill, please.

The support of the BJD, which has nine MPs in the Upper House, is essential since the BJP alone has 93 seats in the Rajya Sabha. Assuming that every member of the Upper House is present and voting, the BJP will also have the backing of the YSRCP’s nine MPs, bringing it that much closer to the necessary 119 votes to win. Sanjay Singh, an AAP MP who has been suspended for the duration of the session and is unable to vote, is one of the 107 MPs that make up the INDIA bloc, along with TRS, which is not a member of the camp.

Party leader Naveen Patnaik served as a minister in the late Atal Bihari Vajpayee’s government from 1998 to 2000, despite the BJD’s assertion that it is equally remote from the BJP and the Congress. after rumors after his meeting with Nitish Kumar, the chief minister of Bihar, Odisha’s longest-serving chief minister, has firmly rejected any notions that the BJD may be a member of a new political front. A meeting with Prime Minister Narendra Modi preceded the Odisha chief minister’s comments, which is interesting. Due to the backing of the Union government, the BJD sees no negative political repercussions in Odisha.
