As the former employee’s appeal is denied, Lord Ranger is upheld

Judge Eady, the president of the Employment Appeal Tribunal, dismissed the woman’s appeal on March 21 against the strikeout of her claim. Instead, he upheld the 2023 ruling that her actions were “scandalous, unreasonable, and vexatious” and acknowledged that she had purposefully obstructed the legal process by destroying evidence, including a notepad and a cell phone.

The woman’s accusation was based on a phone conversation that she had secretly taped on a mobile device without the Ranger’s knowledge and a notebook where she claimed to have jotted down relevant facts.

Ranger’s attorneys wrote to her attorneys in May 2021, requesting access to the phone and notepad for forensic analysis. The lady claimed in a witness statement she provided to the tribunal on October 30, 2022, that both had been destroyed in December of 2020. She said that her husband had burned the pad, and she had thrown away the phone because it had private photos of the two of them that she did not want other people in her neighbourhood to see.

Hyams determined that it was no longer feasible to conduct a fair hearing and struck out her claim, concluding that she had either destroyed them in October 2022 or had lied about having destroyed them.
The lady filed an appeal, claiming that the decision to reject her claim was “unjustifiably draconian” and that Hyams had ignored her ethnic, cultural, and religious background in disregarding her concerns over private photos.

Eady decided that Hyams had a right to draw the conclusion that the woman’s actions were intended to thwart the administration of justice and that the evidence was relevant. She decided that it was reasonable and proper to strike out the claim in order to deal with the matter.
“The decision to vigorously defend the business and its senior leadership against disputed claims of sexual discrimination and harassment is vindicated,” Sun Mark said, after a six-year court struggle. Lord Ranger’s reputation and health have suffered greatly as a result.
