Comments made against PM Modi: The SC will hear Congressman Pawan Khera’s appeal of an HC judgment on Monday

Congressman Pawan Khera will argue his case before the Supreme Court on Monday, contesting the Allahabad High Court’s decision to uphold the criminal case against him for allegedly uttering offensive statements against Prime Minister Narendra Modi.

The case will be heard by a bench consisting of Justices BR Gavai and Prashant Kumar Mishra.

The case was also scheduled for October 13 but was postponed after Khera’s attorney asked for more time to submit some supporting paperwork.

On August 17, the high court rejected Khera’s argument, stating that the evidence gathered by the case’s investigating officer could not be used in a petition submitted under section 482 of the CrPC to have the case dismissed.

It had noted that it would be proper if Khera brought all of his complaints before the chief judicial magistrate in Lucknow, as the top court had requested that he do.

The top court extended Khera’s provisional bail on March 20 and combined three FIRs filed against him in Assam and Uttar Pradesh for allegedly uttering offensive comments against Prime Minister Modi. The case was then sent to the Hazratganj police station in Lucknow.

He had been granted bail in the case by the Lucknow court.

Khera has apologized completely in front of the judge for the alleged insults.

The Congress spokesman was de-boarded from a flight that was scheduled to take him to Raipur on February 23, and he was then detained at the Delhi airport. The highest court did give him temporary release that day, nevertheless, and it was periodically renewed.

 

The Assam Police detained him in connection with his alleged criticism of Prime Minister Modi during a press conference in Mumbai on February 17.
