Kejriwal sues the Supreme Court over the Delhi High Court’s decision to reject his plea contesting his arrest in the liquor scam

New Delhi: A day after the Delhi High Court denied his appeal contesting his apprehension in the liquor policy case, Chief Minister Arvind Kejriwal went to the Supreme Court on Wednesday. At roughly 10.30 am, his attorney will bring up the matter before the nation’s highest court and ask for an immediate hearing.

Notably, the Delhi Chief Minister’s appeal against his detention on March 21 by the Enforcement Directorate (ED) was rejected by the Delhi High Court on Tuesday. The court observed that because Kejriwal disregarded every summons in the money laundering case pertaining to the Delhi liquor scandal, the central agency was left with no other choice. The Delhi CM was accused by the ED of misusing and hiding the profits of crime, a claim that the court also emphasized.

“In addition, this Court maintains that this Court would not establish two distinct sets of laws, one for ordinary citizens and the other giving special privileges to be granted by an investigating agency to a Chief Minister or any other individual in authority solely on the grounds of holding that public office since that public figure enjoys that public office as a result of the public’s mandate,” Justice Swarana Kanta Sharma stated in her statement.

In response to the High Court’s ruling, Delhi Minister Saurabh Bharadwaj said that the searches by the ED and CBI yielded not a single rupee.

They are discussing crores. But the CBI and ED have not discovered a single cent of illicit funds. He said that witnesses had been under pressure to alter their testimony and say what the ED wanted them to. Money laundering is not at issue here. He said, “This is the largest political conspiracy in Indian history.”

He said that Sanjay Singh, the MP for their party, was refused relief by the Delhi High Court on the same basis, disputing the court’s decision to give him release.

He expressed his hope that Arvind Kejriwal will also get justice from the Supreme Court.

Kejriwal first looked to the Supreme Court for justice after his arrest. He quickly had second thoughts, however, and decided to challenge his case in trial court. Interestingly, the Supreme Court refused relief to K. Kavitha, the leader of Bharat Rashtra Samithi and a co-accused in the liquor policy case, on the same day. The high court made it clear that it couldn’t circumvent established protocols and advised Ms. Kavitha to pursue a settlement in the trial court as well.

March 21 saw the arrest of Kejriwal. Arvind Kejriwal was placed in judicial imprisonment by the trial court until April 15, 2024. According to the ED, the Aam Adami Party (AAP) is the primary recipient of the criminal earnings from the purported liquor fraud.Additionally, the agency said that Kejriwal had a direct hand in the creation of the excise policy. The complaint concerns purported anomalies and money laundering in the formulation and execution of the Delhi Excise Policy 2022, which was subsequently withdrawn.
