Three Independent MLAs filed a petition; the Himachal Pradesh High Court is delaying its decision

In a plea filed by three independent MLAs, they claimed that the Speaker was refusing to accept their resignations from the Legislative Assembly and asked the court to step in. The HP High Court has deferred its decision on this matter.

A division bench made up of Justice Jyotsna Rewal Dua and Chief Justice MS Ramachandra Rao heard the case in detail before deferring to their decision.

Today at 4:15 p.m., the hearing got underway, and by video conference, the petitioners’ and the Speaker’s attorneys came before the court. distinguished lawyer Kapil Sibal defended the Speaker of the Vidhan Sabha in court, while distinguished counsel Maninder Singh represented the petitioners.

On March 22, the Secretary of the Assembly received resignations from the three independent MLAs: Hoshiar Singh Chambyal from the Dehra seat, KL Thakur from Nalagarh, and Ashish Sharma from the Hamirpur district. They later had a personal meeting with Speaker Kuldeep Singh Pathania and asked that their resignations be accepted. They later had a meeting with Governor Shiv Pratap Shukla as well.

The three MLAs filed a complaint with the High Court alleging that the Speaker has not accepted their resignation as of yet.

The three have filed a petition challenging the Speaker’s decision to reject their resignations and send them showcause letters. They have argued that the Speaker ought to accept their resignations as they willingly tendered them without being under any duress. In their appeal, the petitioners claimed that the Speaker of the Assembly had sent them showcause letters in order to get a response to their request for a meeting, rather than accepting their resignation. Furthermore, it was claimed that the Speaker’s actions were erroneous and arbitrary.

Speaker’s behavior is “arbitrary”

Three have petitioned against the Speaker’s refusal to accept their resignations and showcause notices, arguing that they willingly tendered their resignations free from any kind of compulsion.
The petitioners claimed that the Speaker had sent them showcause letters in lieu of accepting their resignation.
The three Independent lawmakers also said that the Speaker’s actions were illogical and arbitrary.
