The High Court grants MasterChef India judge Kunal Kapur’s request for a divorce due to his wife’s abuse

Celebrity chef Kunal Kapur was granted a divorce by the Delhi High Court on Tuesday due to the cruelty inflicted by his ex-wife, who treated him with no empathy or respect.

The high court allowed Kunal Kapur’s appeal against a family court judgement that barred him from getting a divorce, finding that it is harsh to publicly accuse a spouse of being irresponsible, slanderous, dehumanising, and without merit.

Given the previously mentioned circumstances of this case, we conclude that the respondent’s (wife’s) behaviour towards the appellant’s (husband) has been lacking in both empathy and decency. A bench made up of Justices Suresh Kumar Kait and Neena Bansal Krishna declared that when one spouse behaves in such a way towards the other, it shames the very foundation of marriage and there is no reason why he should be forced to live through the suffering of cohabitation.
In April 2008, the divorcing couple tied the knot, and their son was born in 2012.
Judge Kunal Kapur, of the television programme “Master Chef,” accused his wife of demeaning and embarrassing him in his plea.
Conversely, the woman said that she was loyal to her husband and always tried to engage with him as a loving spouse, accusing him of fabricating allegations to mislead the court.
She countered that he concealed information from her and made up allegations in order to get a divorce.
While arguments are an inevitable part of every marriage, the court ruled that when such arguments manifest as contempt and disregard for one partner, the marriage loses its sacredness.

It is noteworthy to note that the appellant became a famous chef within two years after being married, which is a testament to his perseverance and hard work. Given the aforementioned circumstances, the bench said that it is only wise to note that these are just accusations made by the respondent in an attempt to harm the appellant’s character in the eyes of the court. Such unfounded statements have the potential to damage someone’s reputation and are thus considered cruel.
