CAA will never be repealed, and the legislation does not violate the Constitution: Amit Shah blasts complaints from the opposition

Amit Shah, the Union Home Minister, has emphasized that the Citizenship Amendment Act cannot be undone and that the Center would not give up its sovereign right to guarantee Indian citizenship inside the nation. Days after the government announced the CAA’s regulations, fulfilling a campaign pledge included in the 2019 Lok Sabha election platform, Shah made these comments.
The Home Minister said that the legislation cannot be repealed and that public knowledge of it would be raised by the government in an interview with news agency ANI.

When questioned about the opposition India group and a Congress leader’s declaration that they would repeal the legislation if they were elected, the Home Minister said that even the opposition is conscious of its slim prospects of winning.

“Even the coalition of INDI is aware that it will not win power. The BJP party and the Narendra Modi-led administration are the ones that introduced CAA. There is no way to undo it. In order to prevent those who want to repeal it from getting a chance, we will raise awareness of it across the whole country,” Shah said.

Claiming that the “CAA is unconstitutional” argument was unfounded, the Home Minister said that the bill complies with all constitutional requirements.

“They bring up Article 14 all the time. They overlook the fact that the article has two sentences. Article 14 is not broken by this statute. This categorization is sensible and unambiguous. This legislation is for people who choose to migrate to India after experiencing religious persecution while living in Afghanistan, Pakistan, or Bangladesh as a result of the partition,” the Union Minister said.

In response to the opposition’s claim that the CAA was informed with the forthcoming Lok Sabha elections in mind, Shah said that the law’s announcement was postponed “because of COVID.”

“I’ll start by discussing the time. The issue of time is irrelevant since all opposition parties—including Rahul Gandhi, Mamata, and Kejriwal—are engaged in jhooth ki rajneeti, or the politics of falsehoods. The BJP has said unequivocally in its 2019 platform that it would implement CAA and grant refugees (from Pakistan, Bangladesh, and Afghanistan) Indian citizenship. The Citizenship (Amendment) Bill was approved by both chambers of Parliament in 2019 as part of the BJP’s well-defined goal. COVID caused a delay in it. Before the party received a mandate from the electorate, the BJP had already finalized its program, he claimed.

“Rules used to be only formalities. Timing, political gain, or loss are irrelevant. The opposition is now attempting to use appeasement politics to increase the size of their support base. I would want to ask that they be made aware of it. “CAA is the national law, and I have said almost forty-one times in the last four years that it will be implemented,” the speaker said.

As the primary goal of the BJP is to bring rights and justice to the persecuted minority coming from Pakistan, Afghanistan, and Bangladesh, the home minister said that there is “no question of political gain.”

“The opposition even brought up the surgical strike and Article 370 abrogation, connecting them to political advantage. Thus, shouldn’t we combat terrorism with force? The Home Minister said, “We have been saying since 1950 that we will withdraw Article 370.”

“I have discussed the CAA in-depth on at least 41 occasions on various forums, emphasizing that minorities in the nation shouldn’t be concerned since it has no provisions that would allow any person to have their rights taken away. With the passage of the CAA, the sufferings of persecuted non-Muslim migrants—including Hindus, Sikhs, Jains, Buddhists, Parsis, and Christians—who fled Bangladesh, Pakistan, and Afghanistan and reached India before December 31, 2014, will come to an end.

Shah attacks Owaisi and Mamata
Amit Shah took issue with West Bengal president Mamata Banerjee and AIMIM president Asaduddin Owaisi for allegedly claiming that the CAA was anti-Muslim.

Amit Shah remarked that West Bengal Chief Minister Mamata Banerjee was inciting panic with her statement over the CAA announcement.

“Mamata Banerjee, please do not insult the Bengali Hindus who have immigrated from Bangladesh. There are hundreds of places for you to engage in politics. You, too, are from Bengaluru. She has my open challenge to identify one provision in this legislation that deprives someone of their citizenship. She’s instilling terror. Mamata Banerjee ought to cease invading her state, but she shouldn’t prohibit us from doing this. Since the BJP is in control in Assam, infiltration has entirely ceased there.

“The time will come when the BJP takes over in West Bengal and puts an end to infiltration.” People will not support you (Mamata Banerjee) if you engage in this kind of politics on such a crucial matter of national security, enable infiltration via appeasement politics, and reject the citizenship of refugees. “Mamata Banerjee lacks the ability to distinguish between an individual seeking asylum and an infiltrator,” he said.

We have a civic and constitutional obligation to provide asylum to individuals who were members of Akhand Bharat and were subjected to persecution or torture in India. If you examine the numbers carefully, you will see that there were 23 percent of Hindus and Sikhs in Pakistan at the time of the split, but that number has now dropped to only 3.7%. In what location are they? They are not back here. They were treated as second-class citizens and subjected to conversion, torture, and insults. Where are they going? Will the nation not consider them, will Parliament not consider them, and should political parties not consider them?” The Minister of Home Affairs said

There are now just 500 Hindus in Afghanistan. Don’t these individuals have the freedom to live according to their beliefs? They were our brothers when Bharat was one,” he said.
