Shah defamation case: Jharkhand High Court rejects Rahul’s petition

Former Congress President and Member of Parliament Rahul Gandhi filed a plea on Friday asking the Jharkhand High Court to halt the trial court’s proceedings in relation to a criminal defamation claim he was sued for after referring to then-BJP President Amit Shah as a “murder accused.” The appeal was denied. Additionally, the court has approved Gandhi’s trial in the MP-MLA court.

This means that he will now face trial in the MP-MLA court. Gandhi’s written version was submitted to the court on February 16; after this, Justice Ambujnath’s court reserved its verdict.

Gandhi said, “The people of this country will accept a lying Bharatiya Janata Party leadership drunk with power because they know that, what the party is designed for,” during his speech at the AICC Plenary Sessions on March 18, 2018. He continued, saying, “They will concede a man facing murderous charges to lead the BJP, but they will never concede the same in the Congress.”

Gandhi was called before the MP-MLA court in Ranchi over the matter, and he was instructed to appear in person. In response, he filed a petition for relief with the Jharkhand High Court. His plea was denied by the HC on Friday, and a trial was mandated against him.

During the course of the 2018 Lok Sabha election campaign, the former head of the Congress made the comments directed against Amit Shah during a public gathering in Chaibasa. The Jharkhand High Court upheld the ruling of the former Ranchi Judicial Commissioner, who concluded that the case against Gandhi under Section 500 of the IPC was plausible on the face of it and noted, “A prima facie reading of the speech indicates that the reference to the BJP has been abundantly made.” Whether or whether these allusions constitute slander remains to be examined.
