Rajasthan High Court Orders Action Against Former CWC Member for Illegal Adoption, Reuniting Mother with Child

The Rajasthan High Court recently ordered punishment against a former Child Welfare Committee (CWC) member who was found guilty of abusing her position by assisting an unlawful adoption.

In a habeas corpus case submitted by a young mother, Justice Rajendra Prakash Soni and Justice Arun Bhansali’s division bench further ordered the petitioner’s nine-month-old infant to be reunited with her.

The petitioner, whose birthday is February 25, 2005, applied to the high court for the return of her little daughter, whom she said her father had abducted.

On August 18, 2022, the woman who filed the petition gave birth to a daughter after eloping with a boy when she was 17 years old. The petitioner was there when the kid was born, along with her father. He took the kid out of her care after the birth.

After turning majority, the petitioner moved in with her boyfriend and later filed a petition asking for custody of her kid. She claimed that she was unaware of her child’s location.

The youngster must appear before the top court, which issued the order in May 2023. The father of the petitioner had given custody of the six-day-old kid to an ex-CWC member, who had then given the child to a lady, according to information provided to the court at a later time.

Her present guardians appeared in court with the kid, telling the judge that the former CWC member had handed them the child.

The former CWC member claimed that the kid had been abandoned by the petitioner’s father and that she had given custody of the child to the present guardians because the youngster required care.

The court expressed concern over the behavior of the child’s mother, who remained silent for over eight months without even caring about the child’s whereabouts and only requested custody after turning 18 while also noting the illegal actions of the former CWC member.

The court ruled that the former CWC member’s acts could not, under any circumstances, be tolerated.

The Rajasthan Government’s Principal Secretary for the Department of Home and the Bhilwara Superintendent of Police have been ordered by the court to take the necessary steps against the former CWC member.

The high court further mandated that the petitioner be awarded custody of the kid.
