Some Elements Of The SC Rahul Verdict Were Not Highlighted During So-Called Celebrations, Says Himanta

Himanta Biswa Sarma, the chief minister of Assam, said on Saturday that several aspects of the Supreme Court’s decision to delay Congressman Rahul Gandhi’s conviction in a defamation case were not addressed during “so-called celebrations.”

Parts of the decision, including the one in which Gandhi was urged to display moderation while giving public statements, were released on Twitter by the top BJP official.

The Supreme Court declares in Paragraph 8 that Rahul Gandhi’s comments are offensive. He should have been more cautious since public figures are required to show moderation while speaking in front of large crowds, he tweeted.

The ruling, according to Sarma, “clearly refers to Rahul Gandhi’s 2019 contempt case before the Hon’ble Supreme Court underlining his credibility as a repeat offender.” He said that the Hon’ble SC makes it plain in Paragraph 12 that the stay would not affect the current appeals procedure at the lower court.

Following the Supreme Court’s ruling on Friday, Sarma said in a mysterious tweet—omitting Gandhi’s name—that the legal system is misused when people are punished but lauded when they are granted bail.

The heights of deceit! When you are found guilty, you exploit the legal system; but, when the same legal system allows you bail, you claim that justice has been done. Gandhi may now return to Parliament and continue bringing the issues of the people before the government, according to the Congress, which had thanked the Supreme Court for upholding justice.

The Gujarat High Court’s ruling rejecting his request for a stay of his conviction in a defamation action stemming from his statement about the “Modi surname” was upheld by the Supreme Court.

In response to Gandhi’s comment made on April 13, 2019, during an election rally in Kolar, Karnataka, former Gujarat minister Purnesh Modi filed a criminal defamation action against Gandhi in 2019. Along with Purnesh Modi, several other BJP officials around the nation have launched defamation lawsuits.
