TCS Allegedly Fired American Employees and Replaced Them With Indians Under H-1B Visa: Report

American workers have been afraid of losing their jobs to foreign competitors who could take lower salaries for years due to the US visa program, which is intended for qualified international workers. A group of seasoned American experts has allegedly made complaints against Tata Consultancy Services, an Indian IT giant, claiming that the company abruptly terminated employees and then filled many of the jobs with H1-B visa holders from India.

At least 22 employees have filed complaints against TCS with the Equal Employment Opportunity Commission since late December. The Wall Street Journal noted that several of the country’s largest companies are among the company’s clients.

Charges Made Against TCS

The Wall Street Journal revealed on Friday that TCS was accused by American employees of participating in unlawful age and racial discrimination. They were accused of having their jobs terminated and having some of their responsibilities transferred to lower-paid temporary work visa holders who were Indian immigrants.

According to reports, the former TCS workers who are American are Caucasian, Asian-American, and Hispanic American. They are between the ages of 40 and 60, and they live in more than a dozen states. A considerable proportion, based on the complaints that have been investigated, has higher credentials, such as master’s degrees in business administration.

According to the article, a TCS representative told the Journal that claims the business engages in illegal discrimination are false and unfounded. According to the cited statement, the representative emphasized that TCS maintains a strong history of being an equal opportunity employer in the United States and operates with honesty.

H-1B Visa Debate: Resurrection

The Journal claims that the accusations bring up issues about Indian IT businesses’ use of H-1B visas once again.

According to the paper, a number of well-known US IT businesses, like Google, Microsoft, and Meta, which have different business models from outsourcing companies, use H-1B visas to acquire high-paying workers. In this sense, these businesses have received relatively less criticism.

Congress authorizes around 85,000 new H-1B visas each year, although the number of applications submitted often exceeds this amount.

The Journal reported on the allegations made by former TCS workers, who said that they were abruptly fired from projects last year even though they had earned praise and sporadic incentives for their work with customers in industries including supply-chain management, operations, and finance over the years.
