Sippy murder case: Kalyani Singh’s request for further papers is denied by the court

A motion by Kalyani Singh, an accused in the murder case of Sukhmanpreet Singh, also known as Sippy Sidhu, to order the CBI to provide further papers was denied by a CBI court at this location.

In accordance with a February 26 Supreme Court ruling, Kalyani Singh submitted an application on April 3 under Section 207 of the Criminal Procedure Code for the provision of witness testimonies and other investigative materials. She also requested the production of a CD, which, upon playing, turned out to be blank. The applicant said that she had not received the records referenced in Serial Nos. 6(a) and 6(b).

On September 20, 2015, Sippy Sidhu, an attorney, was shot and killed in Chandigarh Sector 27.

In its response, the CBI denied the motion and said that all papers had previously been given to the accused in accordance with the judgment of the highest court. This was done via public prosecutor Narender Singh.

According to the CBI, the complainant received all of the items and papers that were sent to the accused, and the record that is now being requested was never provided to anybody, not even the complainant.

According to the CBI, when a similar record was requested before the Special Judicial Magistrate, the accused’s application was dismissed. It was then argued that the accused, under Section 91 of the Criminal Procedure Code, has the right to request the production of any document or article during the trial, provided that the accused becomes aware of it in order to defend herself. Regarding the blank CD, the submission said that a new copy was sent on a pen drive.

CBI Court Special Judge Jagjit Singh rejected the accused’s appeal during a hearing on the case. The accused seems to be bringing this motion just to drag out the proceedings, the court said, adding there was nothing else that needed to be provided to the accused in order for them to comply with the Supreme Court’s ruling.
