Elon Musk’s automaker Tesla has filed a lawsuit in New Delhi against an Indian battery manufacturer, alleging that the latter is violating its trademark by using the term “Tesla Power” to advertise its goods. The firm is demanding damages as well as a permanent injunction against Tesla.

According to details of the proceedings released on the court website on Friday, Tesla said at a hearing at the Delhi High Court this week that the Indian business had continued to advertise its goods with the “Tesla Power” name despite a cease-and-desist letter given in April 2022.

Tesla Power India Pvt. Ltd., an Indian firm, said at the hearing that it does not intend to manufacture electric cars and that its primary business is the production of “lead acid batteries.”

According to the court record, the Indian business sent over a collection of papers supporting its defense, and the judge gave it three weeks to provide a written reply. Tesla, which is owned by Musk and incorporated in Delaware, has charged the Indian business with using the trade names “Tesla Power” and “Tesla Power USA.” Screenshots from a website demonstrating Tesla Power USA LLC’s Delaware headquarters and recognition as a “leader and pioneer in introducing affordable batteries” with “a very strong presence in India” were put in the court record.

An official for Tesla Power said that the company has the necessary regulatory permissions and was operating in India long before Musk founded Tesla. “We have never professed to be associated with Elon Musk’s Tesla company,” Manoj Pahwa of Tesla Power said.

Tesla informed the court that it learned the Indian firm was using its trademark in 2022 and that it had sought in vain to prevent it from continuing, which prompted the complaint.

Musk filed the lawsuit after he postponed his intended April 21 travel to India to meet with Prime Minister Narendra Modi. A few days later, Musk expedited the rollout of its advanced driving assistance package on an unexpected trip to China. On May 22, the Tesla India trademark lawsuit is scheduled to be heard again.
