All You Need To Know About Government Employees Getting a 42-Day Leave for Organ Donation

In light of the time required for rehabilitation, the Center has stated that all government workers would be offered 42 days of leave in the event that they donate any organ of their body. On April 25, this new regulation went into force. The Ministry of Personnel, Public Grievances & Pensions Department of Personnel and Training released a letter in which it was indicated that the donor’s maximum leave period for surgery and recuperation is 42 days. On a licensed doctor’s advice, vacation days will be granted. This is done to encourage organ donation among the staff and is a kind deed to assist and support another person.

According to the Transplantation of Human Organs and Tissues Act of 1994, a donor must have their request for donation authorized by a government-registered physician with a maximum leave of 42 days, regardless of whether they have had surgery or had an organ removed. The donor may use the leaves if advised to do so by a physician or other government-registered medical practitioner one week prior to the procedure. As long as the operation allows it, dividing leaves may be approved by the doctor or other licensed government practitioner.

The announcement further said that, starting on the day it was issued, these regulations would apply to government personnel who had been assigned to civil services and positions related to Union of India matters in accordance with Rule 2 of the CCS (Leave) Rules, 1972.

The Ministry has stated that previously, employees were granted 30 days of leave; however, as a result of numerous inquiries, concerns, and references from the Ministry of Health and Family Welfare, the leave for this special cause of donating an organ by any government employee will be granted 42 days. Organ removal surgery necessitates time for a patient to recover both while they are hospitalized and even after post-hospitalization as proper rest and care are needed to ensure a patient’s survival.

The Central Government Health Scheme requires that the therapy be provided at any approved hospital, whether public or private; if it is, a medical certificate properly signed by the relevant HOD is required.
