Actor and politician Raj Babbar’s conviction in a 1996 case is stayed by the Allahabad High Court

The conviction of actor-politician Raj Babbar in a case that dates back to 1996, when he was running for the Lok Sabha seat from Lucknow as a Samajwadi Party candidate, has been stayed by the Lucknow bench of the Allahabad High Court.

This ruling was made in response to an application submitted by Raj Babbar under Section 389(2) of the CrPC by Justice Mohd. Faiz Alam Khan.

The plea requested instructions to halt the effect, execution, and operation of the July 7, 2022, conviction decision issued by Additional Chief Judicial Magistrate-III for the Lucknow offense stemming from a 1996 police station FIR.

A prosecution witness and a case informant testified, as required by the order, that the event happened on May 2, 1996, during polling.

Raj Babbar’s colleagues were said to have gone with him to a voting place where they got into a fight with the polling party members and accused them of conducting phony polls. The witness went on to say that Babbar stopped his colleagues from doing this, however.

On July 7, 2022, the Additional Chief Judicial Magistrate court in Lucknow found Babbar guilty of the offense under Section 332 of the IPC and sentenced him to a maximum of two years in jail.

Babbar has pending an appeal with the additional sessions judge, MP/MLA court in Lucknow, against this conviction.

He asked the court for orders to halt the implementation, operation, and effect of the July 7, 2022 conviction order. The state attorney, however, was against the application.

Following a hearing on the case, the court ruled that Raj Babbar’s conviction would be delayed, suspended, or placed on hold while the application was pending.
