Instructions for investigation of forcible construction of a gymnasium on agricultural land

The Allahabad High Court has directed the District Magistrate, Jaunpur to investigate the forcible construction of the gymnasium without measuring the land of the petitioner and take action against the guilty officials and submit a compliance report on July 5.
SDM Shahganj, BDO Shahganj, Gram Sabha Saifpur, and village head Ashok Kumar are accused of encroaching on 378 instead of Araji number 434, while Araji number 434 is recorded in the revenue records for the gymnasium.
The court termed the statement of SDM and Tehsildar Shahganj as unfortunate, in which they have said that without partition, the possession of the land cannot be returned to the petitioner. The court has told the District Magistrate that if the court is not satisfied with the action taken against the guilty officers, then higher officials will be summoned and the court will take action itself. The hearing of the petition will take place on July 5. This order has been given by a division bench of Justice VK Birla and Justice Vikas Wednesday on the petition of Nirmala.
Advocates RN Yadav and Abhishek Kumar Yadav argued the petition. He said that Araji number 378 area is 0.158 hectares of his land, which is being encroached upon and construction of a gymnasium is being done by the administration. Whereas a separate land is earmarked for a gymnasium. Leveling work is being done with the JCB machine on the instructions of the SDM after damaging the standing crop.
